A public works contractor or subcontractor violates the act if it does either of the following:

1. (1) Fails to verify the employment eligibility of a new employee through EVP in accordance with the act and this chapter.
2. (2) Makes a false statement or misrepresentation in connection with the completion or submission of the Form to a public body.
