1. (a) Scope. Official action and deliberations by a quorum of the members of an agency are not subject to this chapter if the official action and deliberations predominantly and primarily involve administrative action. Administrative action is the execution of policies relating to persons and things previously authorized or required by official action of the agency adopted at an open meeting of the agency. Administrative action includes, but is not limited to:

   1. (1) Matters related to internal agency operations.
   2. (2) The issuance of permits or licenses based upon nondiscretionary criteria.
   3. (3) Matters related to intergovernmental coordination and cooperation within the executive branch.

2. (b) Limitations. An agency is not engaged in administrative action if the execution of previously authorized policies meets one of the following:

   1. (1) Requires new and significant decisions on important policymaking matters, including the adoption of statements of policy, guidelines and interpretations of law or regulations.
   2. (2) Involves decisions relating to new and significant factual applications of current policies which establish precedents for future agency action.
   3. (3) Relates to the formal adoption of contracts or agreements creating rights, duties or obligation of the Commonwealth and other parties.
