1. (a) The Department will issue a regular license to an ASF when that ASF is in compliance with section 808 of the act (35 P. S. § 448.808) and is in full or substantial compliance with this subpart.

2. (b) As used in subsection (a) ‘‘substantial compliance’’ means:

   1. (1) Deficiencies are, individually and in combined effect, of a minor nature so that neither the deficiencies nor efforts toward their correction will do one of the following:

      1. (i) Interfere with or adversely affect normal ASF operations.
      2. (ii) Adversely affect a patient’s health or safety.
      3. (iii) Exceed the assigned classification of the ASF.
   2. (2) The ASF has adopted a plan of correction approved by the Department.
