1. (a) The Department may issue a provisional license, valid for a specified time period of no more than 6 months, when there are numerous deficiencies or a serious specific deficiency in compliance with applicable statutes, ordinances or regulations but when:

   1. (1) The hospital is taking appropriate steps to correct the deficiencies in accordance with a timetable submitted by the hospital and agreed upon by the Department.
   2. (2) There is no pattern of repeat deficiencies over a period of 2 or more years.
2. (b) A provisional license may be renewed no more than three times at the discretion of the Department.
3. (c) A provisional license may not be issued to allow services or facilities, or parts of facilities, which are subject to Certificate of Need review, but have not been submitted for such review, to be operated pending completion of Certificate of Need review.
