1. (a) The Department may require the operator to obtain and provide proof of coverage for additional liability insurance if one of the following applies:

   1. (1) The permit is renewed, reissued or is subject to a major permit modification.
   2. (2) The Department determines that additional amounts of insurance coverage are required to protect public health or safety, or public welfare or the environment from the risk of injury or damage from the operation of the facility.
2. (b) The Department may review the adequacy of insurance requirements for applicable facilities and, if necessary, require additional amounts of insurance coverage.
