The person proposing remediation shall demonstrate:

1. (1) The property was used for industrial activity.
2. (2) The person did not cause or contribute to contamination on the property.
3. (3) There is no financially viable responsible person to clean up the contamination; or the property is located within a designated enterprise zone.
