25 Pa. Code § 240.402 – Civil penalties.

(a) The Department may assess a civil penalty for a violation of the acts or this chapter.
(b) A civil penalty may be assessed or increased, based upon:
1. (1) The seriousness of the violation.
2. (2) The monetary loss of an owner or occupier, including the cost to the owner or occupier to remedy the violation.
3. (3) The risks to health and safety.
4. (4) The cost to the Commonwealth in administration, inspection and enforcement, to remedy the violation.
5. (5) The costs avoided by the violator by the violation.
6. (6) The culpability of the violator.
7. (7) The frequency of the violation.
(c) Each day of a continuing violation is considered a separate violation for purposes of this chapter.
