The following terms, when used in this subchapter, have the following meanings, unless the context clearly indicates otherwise:

1. (1) The meanings for the terms ‘‘active workings,’’ ‘‘berm’’ and ‘‘roll protection’’ contained in 30 CFR 77.2(a), (d) and (w) (relating to definitions) are incorporated by reference.
2. (2) Competent person—A person having abilities and experience that fully qualify him to perform the duty to which he is assigned.
