25 Pa. Code § 92a.7 – Duration of permits and continuation of expiring permits.

(a) NPDES permits must have a fixed term not to exceed 5 years.
(b) The terms and conditions of an expiring permit are automatically continued when the following conditions are met:
1. (1) The permittee has submitted a timely application for reissuance of an existing permit in accordance with § 92a.75 (relating to reissuance of expiring permits).
2. (2) The Department is unable, through no fault of the permittee, to reissue or deny a permit before the expiration date of the previous permit.
(c) Permits continued under subsection (b) remain effective and enforceable against the discharger until the Department takes final action on the pending permit application.
