PERMIT ISSUANCE, TRANSFER AND REVOCATION

1. (a) The Department may grant a permit if it determines that the following applies:

   1. (1) The application is complete.
   2. (2) The proposed project or action complies with the standards and criteria of this chapter, The Flood Plain Management Act (32 P. S. § § 679.101—679.601) and The Clean Streams Law (35 P. S. § § 691.1—691.1001).
   3. (3) The proposed project or action will not threaten public health, safety and welfare.
2. (b) Any permit issued under this chapter shall be subject to such general and special conditions regarding construction, operation, maintenance, inspection and monitoring of a project or action as the Department may deem necessary to assure compliance with the requirements and purposes of this chapter, The Flood Plain Management Act (32 P. S. § § 679.101—679.601) and The Clean Streams Law (35 P. S. § § 691.1—691.1001).
