1. (a) The required application and supporting documentation shall be filed with the Department prior to February 1 annually. No application received by the Department or postmarked later than January 31 will be accepted for processing by the Department. If January 31 falls on a Saturday, Sunday or State or Federal holiday, the deadline will be the next business day.
2. (b) Applications shall be submitted on forms supplied by the Department.

The EHB properly granted Department of Environmental Resources’ Motion for Summary Judgment in an appeal from a DER action refusing to process an application for an annual subsidy for the operations of a sewage treatment plant when the application was postmarked after January 31 deadline.
