Projects which meet both of the following criteria are eligible for construction grants:

1. (1) The eligible costs of the project based on construction bids or actual construction and associated costs exceed the amount of grant funds made available from other State and Federal grant sources.
2. (2) The municipality to be served by the proposed project suffers from unusual financial hardship and State grant funds are available for the project. In evaluating the extent of financial hardship, the Department will consider the ratio of the median family income in the municipality to be initially served by the project to the State median family income and the annual sewer rental to be charged.
