1. (a) Appropriate erosion and sediment control measures shall be designed, constructed and maintained using the best technology currently available to:

   1. (1) Prevent, to the extent possible, contributions of sediment to stream flow or to runoff outside the affected area.
   2. (2) Meet the treatment requirements and effluent limitations of § 90.102 (relating to hydrologic balance: water quality standards, effluent limitations and best management practices).
   3. (3) Minimize erosion to the extent possible.
   4. (4) Meet the requirements of Chapter 102 (relating to erosion and sediment control).
2. (b) All areas disturbed by coal refuse disposal activities shall be permanently stabilized as soon as practicable.
