25 Pa. Code § 89.37 – Existing structures.

(a) The operation plan shall contain a description of each existing structure proposed to be used in connection with or to facilitate the mining operation. The description shall include the following:
1. (1) Location.
2. (2) Current condition.
3. (3) A demonstration that the structure is in compliance with the performance standards of this chapter.
(b) The operation plan shall describe how each noncomplying existing structure will be modified or reconstructed to comply with the design and performance standards of this chapter. The description shall include the following:
1. (1) Design specifications for the modification or reconstruction of the structure.
2. (2) A construction schedule.
3. (3) Provisions for monitoring the structure during and after modification or reconstruction.
4. (4) A showing that the risk of harm to the environment or to public health or safety is not significant during the period of modification or reconstruction.
