25 Pa. Code § 86.16
Persons submitting permit applications under § 86.14(a) (relating to permit application filing deadlines), shall reapply for a permit within 2 months by submitting an initial application on forms available from the Department and shall thereafter submit a complete application, including proof of publication, in accordance with a schedule determined by the Department. Other applications submitted under § 86.14(b) shall be complete and include, at a minimum, the applicable information required under this chapter and:

As the Department of Environmental Resources refused to process Petitioner’s application for a mining permit, petitioners subsequently commenced an action to compel the Department to process their application, and based on a prior Superior Court decision, requested the production of two memoranda for discovery which the Court determined to be protected from discovery under the work product doctrine as to one memorandum and immune on the basis of the attorney-client privilege as to the other.
