Under this subchapter, the Department may issue general permits for any category of noncoal surface mining activities if the Department determines the following:

1. (1) The activities in the category are similar in nature.
2. (2) The activities in the category can be adequately regulated utilizing standardized specifications and conditions.
3. (3) The activities in the category, in the opinion of the Department, are more appropriately regulated under a general permit than under individual permits.
