1. (a) Highwalls shall be set back from the boundary of the area covered by a bond under § 77.193 (relating to requirement to file bond). The setback shall be of sufficient width to accomplish the following:

   1. (1) Prevent possible slumping or failure at or beyond the perimeter of the permit area.
   2. (2) Allow for the development of final reclamation slopes.
2. (b) The minimum setback distance shall be 25 feet (7.62 meters) in consolidated material, in unconsolidated material, the minimum setback distance shall be equal to the height of the exposed unconsolidated material unless otherwise approved by the Department.
3. (c) The setback shall be shown on the cross sections.
