- (1) Any physician having agreed with a patient to perform any surgical operation or procedure, shall perform the surgery personally or, prior to surgery, shall inform the patient that the physician will not be performing the surgery.
- (2) This section shall not apply when the physician, because of an emergency, cannot personally notify the patient that the physician will not be performing the surgery.
