1. (1) A commercial fishing license must be obtained by each individual who, for commercial purposes:

   1. (a) Takes or assists in the taking of any food fish from the waters or land of this state;
   2. (b) Operates or assists in the operation of any boat or fishing gear for the taking of food fish in the waters of this state; or
   3. (c) Lands food fish from the waters of the Pacific Ocean at any point in this state.
2. (2) A commercial fishing license must be in the possession of the licensee, when engaged in the taking or landing of commercial fish, and is required in addition to any other license under this chapter.

3. (3) Notwithstanding any other provision of this section or ORS 508.035, upon application of the holder of a boat license, the State Fish and Wildlife Commission shall issue to the applicant in the name of the boat, one commercial fishing license for each individual who assists the holder of the boat license in the taking of fish for commercial purposes. Notwithstanding ORS 508.465, licenses issued pursuant to this subsection are transferable to all individuals who assist in the taking of fish for commercial purposes on the boat for which the licenses are issued. Notwithstanding ORS 508.285, the fee for the license issued pursuant to this subsection in the name of a boat:

   1. (a) With a resident boat license is $125 for each individual.
   2. (b) With a nonresident boat license is $175 for each individual.
