Or. Rev. Stat. § 475A.338 – Ability of health care provider, behavioral health care provider, to conduct certain sessions; protection from discipline

(1)
1. (a) As used in this subsection, “board” means:
  1. (A) The Oregon Board of Licensed Professional Counselors and Therapists;
  2. (B) The Oregon Board of Naturopathic Medicine;
  3. (C) The Oregon Board of Psychology;
  4. (D) The Oregon Medical Board;
  5. (E) The Oregon State Board of Nursing;
  6. (F) The State Board of Licensed Social Workers; and
  7. (G) The State Board of Pharmacy.
2. (b) A person who is licensed or otherwise authorized by a board to provide health care or behavioral health care services and who holds a license under ORS 475A.325 may, in accordance with the provisions of ORS 475A.210 to 475A.722 and rules adopted under ORS 475A.210 to 475A.722:
  1. (A) Conduct preparation sessions and integration sessions with clients in addition to and while providing health care or behavioral health care services.
  2. (B) Conduct administration sessions with clients, so long as the person does not provide health care or behavioral health care services while providing psilocybin services.
(2) A health care provider, as defined in ORS 127.505, may not be subject to a civil penalty or other disciplinary action by the state agency that regulates the health care provider for:
1. (a) Discussing with a client or patient, as a treatment option, psilocybin services provided by a psilocybin service facilitator that holds a license issued under ORS 475A.325 at a psilocybin service center for which a license is issued under ORS 475A.305; or
2. (b) If the health care provider holds a license issued under ORS 475A.325, providing psilocybin services in accordance with the provisions of ORS 475A.210 to 475A.722 and rules adopted under ORS 475A.210 to 475A.722, so long as the health care provider does not provide health care services while providing psilocybin services.
