As used in ORS 459A.100 to 459A.120:

1. (1) “Domestic solid waste” includes but is not limited to residential, commercial and institutional wastes generated within this state.

2. (2) “Domestic solid waste” does not include:

   1. (a) Sewage sludge or septic tank and cesspool pumpings;
   2. (b) Building demolition or construction wastes and land clearing debris, if delivered to a disposal site that is limited to those purposes;
   3. (c) Source separated recyclable material, or material recovered at the disposal site;
   4. (d) Waste going to an industrial waste facility;
   5. (e) Waste received at an ash monofill from an energy recovery facility; or
   6. (f) Other material excluded by the Environmental Quality Commission in order to support the policies of ORS 459.015.
