1. (1) Each school district shall allow the following during school hours, at a school-sponsored activity or while under the supervision of school personnel:

   1. (a) The outdoor use by students of sun-protective clothing, including hats.
   2. (b) The application of and use by students of nonprescription sunscreen, including sunscreen that contains para-aminobenzoic acid, without any required documentation from a licensed health care professional.
2. (2) Nothing in subsection (1)(a) of this section prevents a school district from prohibiting certain clothing or hats based on the inappropriateness of the graphics, color or message of the clothing or hats.
3. (3) A school district may allow school personnel to assist students in applying nonprescription sunscreen but may not require school personnel to assist students in applying nonprescription sunscreen.
4. (4) School personnel may not be held liable in a criminal action or for civil damages for application of nonprescription sunscreen, including sunscreen that contains para-aminobenzoic acid, if the nonprescription sunscreen is available to and used by the student in accordance with this section.
