1. (1) After receiving notice of the building official’s discretionary decision, a permit applicant has 30 days to submit an appeal to the local board.
2. (2) In an appeal before the local board, the permit applicant has the burden of establishing by a preponderance of the evidence that overturning the discretionary decision of the contract building official will not create a dangerous or unsafe condition or decrease the minimum fire and life safety standards set forth in the relevant code.
3. (3) Upon receipt of a notice of appeal, the local board has 30 days to review the appeal and issue a determination.
4. (4) The appeal rights to which a permit applicant is entitled before a local board is in addition to, and not in lieu of, any other rights of appeal the permit applicant may have.
