1. (1) If a party fails to appear at a conference or hearing, then that party waives its right to participate in the conference or hearing.
2. (2) Unless allowed by the Commission or ALJ, the party that failed to appear may not reopen any matter decided at the conference or hearing, or recall for further examination witnesses available at the hearing and excused.
3. (3) Upon motion by any party or upon the Commission’s own motion, the Commission may enter an order dismissing a party that failed to appear at a hearing from the entire proceedings. The order must be served on the party dismissed. If the Commission or ALJ finds there was good cause for the party’s failure to appear or the interests of other parties or the public would be prejudiced, then the Commission or ALJ may reinstate the party.
