1. (1) The Commission delegates to the ALJ authority to:

   1. (a) Regulate the course of rulemaking, contested case, and declaratory ruling proceedings, including scheduling, recessing, reconvening, and adjourning hearings;
   2. (b) Administer oaths;
   3. (c) Issue subpoenas;
   4. (d) Make evidentiary rulings;
   5. (e) Supervise and control discovery;
   6. (f) Hold appropriate conferences before, during, or after hearings;
   7. (g) Decide procedural matters, but not to grant contested motions to dismiss or other contested motions that involve final determination of the proceedings;
   8. (h) Change filing deadlines;
   9. (i) Grant waivers of rules;
   10. (j) Certify a question to the Commission for consideration and disposition;
   11. (k) Determine the order in which evidence will be presented;
   12. (l) Issue a protective order to limit disclosure of confidential information; and
   13. (m) Take any other action consistent with the duties of an ALJ.
2. (2) The ALJ must conduct proceedings in a fair and impartial manner and maintain order. If a person engages in conduct that interferes with this duty, then the ALJ may suspend the proceeding or exclude the person from the proceeding.
