As used in these rules:
(1) "Act" means the Uniform Controlled Substances Act, ORS Chapter 475, and rules thereunder;

1. (2) "CFR" means Code of Federal Regulations;
2. (3) "USC" means United States Code;

3. (4) "Emergency Situations" means those situations in which the prescribing practitioner who authorizes an oral prescription of a controlled substance listed in schedule II of the Federal Controlled Substances Act determines that:

   1. (a) Immediate administration of the controlled substance is necessary, for proper treatment of the intended ultimate user; and
   2. (b) No appropriate alternative treatment is available, including administration of a drug which is not a controlled substance under schedule II of the Act, and
   3. (c) It is not reasonably possible for the prescribing practitioner to provide a written prescription to be presented to the person dispensing the substance prior to the dispensing.
4. (5) Terms not defined in this rule have the definitions set forth in ORS 475.005.
