For purposes of the notice requirement under ORS 743.560, replacement of the terminated group health insurance coverage occurs when all classes of persons covered by the terminated policy are eligible for coverage:

1. (1) Under a group health insurance policy of the group policyholder that takes effect on the day after the end of the period through which coverage is paid up; or
2. (2) Under one or more group health insurance policies of the group policyholder in existence at the termination of the terminated policy.
