1. (1) The agency may evaluate and approve pre-licensure training based on written evaluation criteria approved by the Training and Education Committee and made available to pre-licensure training providers. The agency may revoke a pre-licensure training provider’s right to offer pre-licensure training if a pre-licensure training provider’s training does not meet the approved criteria.

2. (2) The hours of pre-licensure training required under OAR 812-006-0150 shall consist of the following topics:

   1. (a) Construction Contractors Board:

      1. (A) Role and authority, licensing requirements, application procedures and major divisions and functions;
      2. (B) Dispute resolution processes;
      3. (C) Business entities;
      4. (D) Mandatory consumer notices;
      5. (E) Rights and responsibilities of consumers and contractors;
      6. (F) Independent contractor requirements;
      7. (G) Exempt and non-exempt contractors;
      8. (H) License endorsements and requirements for bonds and insurance;
      9. (I) Special licenses;
      10. (J) Written contract requirements;
      11. (K) Warranty and maintenance schedule requirements;
      12. (L) Enforcement program; and

   2. (b) Employer requirements and employee’s rights:

      1. (A) State agencies that regulate workplace issues;
      2. (B) Information and resources on employer requirements, employee’s rights, workers’ compensation insurance, and required workplace postings;
      3. (C) Civil rights;
      4. (D) Title VII, child labor, and important state and federal wage and hour laws;
      5. (E) Current minimum wage rate requirements;
      6. (F) Prevailing wage rate law; and
      7. (G) Employees and independent contractors.

   3. (c) Taxes, record keeping and business practices:

      1. (A) Required employment forms;
      2. (B) Identification numbers;
      3. (C) Cost of employees;
      4. (D) Importance of good record keeping;
      5. (E) Ways to organize records;
      6. (F) Required tax forms and reporting times;
      7. (G) Professional help;
      8. (H) Profit and cash flow; and
      9. (I) Requirements for business licenses.

   4. (d) Building codes:

      1. (A) Applicable codes;
      2. (B) Building codes books;
      3. (C) Code revisions;
      4. (D) Specialty licenses and inspections;
      5. (E) Required and exempt permit work;
      6. (F) Permit applications permit violation penalties;
      7. (G) Required inspections;
      8. (H) Inspection procedures;
      9. (I) Final inspections and occupancy permits; and
      10. (J) Red tag/stop work orders.

   5. (e) Oregon Occupational Safety and Health Division:

      1. (A) OR-OSHA regulations, job site inspections and resources;
      2. (B) Equipment basics and maintenance;
      3. (C) Job site record keeping;
      4. (D) General safety practices; and
      5. (E) Responsibilities and relationships among contractors and subcontractors on a job site.

   6. (f) Sound environmental practices and laws:

      1. (A) Environmental friendly materials;
      2. (B) Good recycling, reduction and reuse methods;
      3. (C) Hazardous waste and special waste found in new and old construction;
      4. (D) Laws and regulations governing environmental hazards, proper handling and disposal methods of environmental hazards and job site debris;
      5. (E) Governmental agencies that regulate environmental conditions at a job site;
      6. (F) Environmental violation penalties;
      7. (G) Site preparation including construction activities that impact rivers;
      8. (H) Soil erosion; and
      9. (I) Wetlands, water quality, sewage and underground storage/heating oil tanks.

   7. (g) Contract law:

      1. (A) Clear and concise contracts;
      2. (B) Four elements of contract law;
      3. (C) Three elements of a construction contract;
      4. (D) Breach of contract;
      5. (E) Minor and major breach of contract;
      6. (F) Written and verbal contracts and change orders;
      7. (G) Contractor responsibilities for work of self and others;
      8. (H) Partnering, negotiation, mediation, arbitration and litigation; and
      9. (I) Buyer’s Right to Cancel.

   8. (h) Oregon construction lien law:

      1. (A) Purpose;
      2. (B) Required notices;
      3. (C) Lien law procedures;
      4. (D) Steps and timelines to perfect a lien and foreclose; and

      5. (E) Important lien law differences of other states.

         1. (i) Project management, estimating and scheduling:
      6. (A) Importance of project management and consequences for failing to do so;
      7. (B) Simple written budgets that include cost, overhead and profit; and
      8. (C) Simple project schedules and consequences of improper job scheduling.

   9. (j) Building Exterior Shell Training (BEST):

      1. (A) Need for BEST;
      2. (B) Contractor’s responsibility to construct weather-resistant building exterior shell;
      3. (C) Purpose of building exterior shell;
      4. (D) Primary components of building exterior shell;
      5. (E) Basic moisture management concepts;
      6. (F) Exterior wall assemblies; and
      7. (G) Best practices for building exterior shell construction.
