1. (1) For complaints filed under ORS 701.145, the agency may include the following costs in the amount of a judgment that is subject to payment by a surety or financial institution:

   1. (a) Court costs;
   2. (b) Interest;
   3. (c) Costs, other than attorney fees, to pursue litigation or the complaint; or
   4. (d) Service charges or fees.
2. (2) For complaints filed under ORS 701.145, the agency’s determination of payment due from a surety or financial institution may not include amounts arising out of claims for anything other than construction work involving negligence, improper work or breach of contract.
