1. (1) Upon receipt of an application the Department shall determine whether the proposed Project is eligible for Program Funds. Proposed Projects that meet the following criteria are eligible:

   1. (a) The applicant is a short line railroad;
   2. (b) The Project will not require or rely upon continuing subsidies from the Department; and
   3. (c) The applicant is current on all state and local taxes, fees and assessments.

2. (2) If the Project is not eligible, the Department shall, within 30 days:

   1. (a) Reject the application; or
   2. (b) Require the applicant to submit additional information as may be necessary.
