1. (1) The Department shall notify applicants for permits or licenses or renewals of permits or licenses listed in OAR 738-130-0025 of their responsibility to demonstrate compliance and compatibility.
2. (2) The Department shall not issue a permit unless certification of compatibility is demonstrated by the applicant. The Department may deny, condition or further restrict a permit that is compatible as necessary to carry out applicable Department rules and statutes.
3. (3) Certification shall be documentation that all local land use planning approvals have been obtained or a written statement by a planning official of the affected city or county that the application complies with the acknowledged comprehensive plan but no local land use approvals are needed.
