(1) The department may cancel a solicitation or may reject all offers when the cancellation or rejection is in the best interest of the department as determined by the department.
- (a) The reasons for the cancellation or rejection must be made a part of the procurement file.
- (b) The department is not liable to any offeror for any loss or expense caused by or resulting from the cancellation of a solicitation document, or the rejection of any or all offers.
(2) Notice of Cancellation. If the department cancels a solicitation prior to opening, the department shall provide notice of cancellation in accordance with OAR 736-149-0210. Such notice of cancellation shall:
- (a) Identify the solicitation;
- (b) Briefly explain the reason for cancellation; and
- (c) If appropriate, explain that an opportunity will be given to compete on any resolicitation.
- (3) After Offer Opening. If the department rejects all offers, the department shall retain all such offers as part of the department's solicitation file.
