Or. Admin. R. 736-149-0245 – Modification or Cancellation of Solicitation Process

(1) Modification: The department may modify or cancel a solicitation document as follows:
1. (a) Modification Issuance: Any changes to the solicitation document will be by written addenda.
2. (b) Addenda Issuance: The department will issue addenda in the manner described in the solicitation document or, if not described in the solicitation document, by providing notice within a reasonable time before closing to allow offerors to consider the addenda in preparing bids or proposals. See OAR 736-149-0250 for additional details.
3. (c) Extension of Closing: The department may extend closing if it determines that offerors need additional time to review and respond to addenda.
(2) Cancellation: The department may cancel a procurement at any time before execution of a contract, if it is determined in the department's best interests to do so.
1. (a) The department is not liable to any person or offeror for any loss or expense resulting from such cancellation.
2. (b) The department will document reasons for cancellations in its files.
3. (c) The department will retain any proposal it receives in accordance with applicable law. The department will not return offers unless explicitly requested by the offeror
