(1) In addition to the rules set forth in Division 146, 147 and 148, these division 149 rules apply to public improvement procurements and contracts as well as procurements and contracts for ordinary construction services that are not public improvements. Rules that apply specifically to public improvements are so identified.
(2) Emergency Contracts for construction services are not public improvement contracts and are regulated under OAR 736-147-0030.
(3) The dollar threshold amounts that are applicable to the selection procedures are independent from and have no effect on the dollar threshold amounts that trigger the legal sufficiency review requirement for the department under OAR 137-045-0030.
