DMV will waive the examination requirement for an applicant for a farm endorsement when the applicant does not meet the waiver criteria provided in ORS 807.072(4) or (5) because of a traffic accident on the applicant’s two-part driving record that occurred within two years of the application date if:

1. (1) The applicant was not convicted of a traffic offense related to the accident; and
2. (2) The accident is not marked in the Oregon driving record as a preventable accident, as defined in OAR 735-072-0020.
