1. (1) For the purpose of this rule the following definitions apply:

   1. (a) "Duplicate plate(s)" means the registration plate(s) issued to a vehicle, as provided in ORS 803.530, and has the same number or letter sequence and background as the plate(s) last assigned to the vehicle.
   2. (b) "Replacement plate(s)" means the registered plate(s) issued to a vehicle, as provided in ORS 803.530, and has a different number or letter sequence than the plate(s) last assigned to the vehicle.
2. (2) The vehicle owner may make application to the Driver and Motor Vehicle Services Division of the Department of Transportation (DMV) for replacement or duplicate plates.

3. (3) To obtain replacement or duplicate plates the vehicle owner must make application to DMV and:

   1. (a) Pay the replacement or duplicate plate fee as provided in ORS 803.575;
   2. (b) Pay the plate manufacturing fee when required under ORS 803.570 and as provided in OAR 735-032-0010; and
   3. (c) Meet any other applicable requirements for the title and registration of the vehicle.
4. (4) DMV will determine whether the plates are required to be issued as duplicate plates or replacement plates. In most cases, DMV will issue replacement plates.

5. (5) If DMV determines the plates may be issued as duplicate plates, DMV will issue two registration plates unless the vehicle owner requests DMV issue only one duplicate registration plate. In order to issue only one duplicate registration plate, the plate to be replaced:

   1. (a) Must be a passenger registration plate type that is from a current issue, as defined in OAR 735-046-0000; and
   2. (b) Must not be stolen.

6. (6) When DMV issues a single registration plate in accordance with Oregon Laws 2021, Chapter 630, Section 126:

   1. (a) The registration plate will be issued as a duplicate to the currently assigned registration plate for the vehicle; and
   2. (b) DMV will issue two replacement registration month and two registration year stickers, if applicable. The owner must replace the stickers on the registration plate not being replaced in addition to adding the registration stickers to the newly issued single registration plate.
