1. (1) Upon submitting a district permanent transfer application to the Department pursuant to ORS 540.572 and OAR 690-385-5000, a district shall:

   1. (a) Provide notice to the users of affected lands that a district permanent transfer application was submitted to the Department;
   2. (b) Provide the users of affected lands a copy of the application and map; and
   3. (c) Mail the notice, application, and map to the last known address of the affected users by certified mail with a request for a return receipt.

2. (2) The notice under subsection 1(a) of this rule shall inform the users of affected lands that:

   1. (a) The Department shall approve the district permanent transfer application as provided under OAR 690-385-5600 unless:

      1. (A) The application does not include the information required under OAR 690-385-5200; or
      2. (B) The user, of lands from which water rights are to be transferred, submits a protest pursuant to OAR 690, division 002.
   2. (b) The user has the right to protest the application as described in OAR 690-385-5700.
