1. (1) Base penalties shall be determined through the use of the following matrix:

   1. (a) Class I:

      1. (A) Major, $1000;
      2. (B) Moderate, $500;
      3. (C) Minor, $250.

   2. (b) Class II:

      1. (A) Major, $500;
      2. (B) Moderate, $250;
      3. (C) Minor, $125.

   3. (c) Class III:

      1. (A) Major, $200;
      2. (B) Moderate, $100;
      3. (C) Minor, $50.

2. (2) Penalty Formula:

   P = BP X R

   (The formula may include adjustments as described in OAR 690-260-0080). Where P = Penalty in dollars

   1. (a) BP = Base Penalty in dollars from matrix in section (1) of this rule;

   2. (b) R = Repeat factor from numbers below:

      1. (A) 1st Violation, R = 1;
      2. (B) 2nd similar violation, R = 2;
      3. (C) 3rd similar violation, R = 3;
      4. (D) 4th similar violation, R = 4;
      5. (E) 5th similar violation, R = 5.
