Administrative Rule Compliance

Effective Jan 1, 2026ORS 197.820(4)(a) & ORS 197.820(4)(b) | Statutes/Other Implemented: ORS 197.830(9), ORS 197.830(13)(a) & ORS 197.830(15)Land Use Board of Appeals

(1) The Board may, on its own motion, dismiss a party for lack of prosecution.
(2) A party will be dismissed for lack of prosecution if:
1. (a) The party has failed to comply with these rules of procedure;
2. (b) The Board has mailed a notice of noncompliance to the noncompliant party at the mailing address provided for such party in the notice of intent to appeal, motion to intervene, or notice of representation;
3. (c) The Board has not received a satisfactory response to the notice of noncompliance from the noncompliant party;
4. (d) The Board has issued an order to show cause why the noncompliant party should not be dismissed; and
5. (e) The Board has not received a satisfactory response to the order to show cause from the noncompliant party.
