- (1) Except as provided in subsection (2) of this rule, documents, materials, and reports related to screenings, investigations, and determinations conducted pursuant to OAR 581-055-0001 to 581-055-0014 are confidential and not subject to public inspection.
(2) To the extent allowed by state and federal law, upon request, ODE shall make documents, materials, and reports described in subsection (1) of this rule available to:
- (a) A law enforcement agency or ODHS, if necessary to conduct an investigation under ORS 419B.005 to 419B.050;
- (b) TSPC, if necessary to conduct an investigation under ORS 339.390 or ORS 342.176; and
- (c) An education provider, if necessary for the education provider to take disciplinary action or make changes in the employment relationship or duties of a school employee, contractor, agent or volunteer.
- (3) ODE shall retain documents and materials related to any report received under this rule for a period of 75 years.
