No Sponsor shall execute a contract or otherwise agree, formally or informally, to purchase food service management services except when all of the following conditions are fulfilled:

1. (1) The contract is in compliance with all applicable laws, rules and regulations, including but not limited to guidelines promulgated and published by the United States Department of Agriculture pursuant to the National School Lunch Program, School Breakfast Program, Child and Adult Care Food Program, or Summer Food Service Program;

   1. (a) The agreement for Food Service Management Services is made in writing, contains all terms required by OAR 581-051-0580 herein;
   2. (b) The FSMC has been selected after a procurement process that conforms to the requirements of OAR 581-015-0570 herein;
2. (2) The contract is approved by the Sponsor's board or governing body; and
3. (3) The contract has been reviewed and approved by the Department.
