1. (1) A public education program may not:

   1. (a) Purchase, build or otherwise take possession of a seclusion cell; or
   2. (b) Use a seclusion cell.
2. (2) No later than July 1, 2013, a public education program shall ensure that all seclusion cells are removed from the classrooms of the public education program.
3. (3) No later than September 1, 2013,a public education program shall ensure that all seclusion cells are removed from the premises of the public education program.
4. (4) Notwithstanding the applicability date specified in OAR 581-021-0568 the prohibition on the use of seclusion cells under this rule is effective and applicable beginning on or after April 5, 2013.
