1. (1) The Department will identify schools eligible to receive the SSA Summer Program Grants in accordance with ORS 327.341(1). The Department will ensure geographic representation of identified student groups are included throughout the state.

2. (2) The following shall be eligible to receive an SSA Summer Program Grant:

   1. (a) A public school district on behalf of a public school identified by the Department to receive the grant. The public school must be within the school district receiving the funds, and
   2. (b) A public charter school identified by the Department to receive the grant.

3. (3) A grant recipient may use grant funds to contract for the provision of summer program services.

   1. (a) Contracts may be established with federally-recognized Tribal governments, education service districts (ESDs), education-focused non-profit organizations, and other qualified entities for purposes allowed in this rule.
   2. (b) Any contracts entered into for the purposes allowed in this rule must meet program requirements as established in OAR 581-017-0632.
