The Commission may waive all or part of the fees and penalties owed to the Commission under the following circumstances:

1. (1) Upon receiving written documentation acceptable to the Commission of the death of the participant; or
2. (2) Upon receiving written documentation acceptable to the Commission of the total and permanent disability of the participant; or
3. (3) After consideration by the Commission and the Office of Rural Health of a written appeal from the participant for a waiver of the minimum service obligation.
