For purposes of ORS 657.155(1)(c), an individual who is in all respects otherwise eligible for unemployment insurance benefits shall not be denied benefits solely by reason of serving on jury duty provided:

1. (1) The individual does not miss an opportunity to perform suitable work as a result of jury duty; and
2. (2) The individual actively sought work during the hours and days of the week in which the individual was not engaged in serving on jury duty.
