- (1) Applicability. This rule applies to all advance deposit wagering licensees (ADWs or hubs) licensed under Division 220 that operate accounts for Oregon residents and are subject to an approved source market mitigation plan.
- (2) Monthly Remittance. A hub must remit all source market fees owed for wagering activity occurring in a calendar month no later than 60 days after the end of that month. If a mitigation plan requires payment to more than one commercial race meet licensee, the hub must remit each licensee's allocated share within the same 60- day period.
(3) Monthly Statement. At the time of remittance, the hub must provide to each affected commercial race meet licensee and to the Commission a monthly statement showing:
- (a) Oregon account handle;
- (b) The amount due and paid; and
- (c) Any adjustments or credits.
(4) Delinquent Payments. Any source market fee not paid within the required timeframe is delinquent.
- (a) Delinquent amounts accrue simple interest at one percent per month from the due date until paid, unless otherwise ordered by the Commission.
- (b) The Executive Director may grant a brief extension for good cause shown.
- (5) Records and Audit. Hubs must maintain records sufficient to substantiate source market fee calculations and payments for at least five years and must make those records available to the Commission upon request.
- (6) Enforcement. Failure to comply with this rule may result in administrative action under ORS Chapter 462 and Division 220, including fines, license conditions, suspension, or revocation.
