1. (1) Purpose. The purpose of the rules in OAR 436-030 is to provide standards, conditions, procedures, and reporting requirements for:

   1. (a) Requests for closure by the worker;
   2. (b) Claim closure under ORS 656.268(1);
   3. (c) Determining medically stationary status;
   4. (d) Determining temporary disability benefits;
   5. (e) Awards of permanent partial disability;
   6. (f) Determining permanent total disability awards;
   7. (g) Review for reduction of permanent total disability awards;
   8. (h) Review of prior permanent partial disability awards; and
   9. (i) Reconsideration of notices of closure.

2. (2) Applicability of rules.

   1. (a) Except as provided in subsections (c) and (d) of this section, the rules in OAR 436-030 apply to all accepted claims for workers’ compensation benefits and all claims closed on or after the effective date of these rules.
   2. (b) All orders the division issues to carry out the statute and the rules in OAR 436-030 are considered orders of the director.
   3. (c) For claims in which the worker became medically stationary before July 2, 1990, OAR 436-030-0020, 436-030-0030, and 436-030-0050 as adopted by WCD Administrative Order 13-1987, effective January 1, 1988, will apply.
   4. (d) OAR 436-030-0055(3)(b), (3)(d), and (4)(a) apply to all claims with dates of injury on or after January 1, 2002.
   5. (e) The director may waive procedural rules as justice requires, unless otherwise obligated by statute.
