1. (1) Overpayments are a benefit or service received by or on behalf of the individual, or a payment made by the Department on behalf of an individual that exceeds the amount for which the individual is eligible.
2. (2) All overpayments for the ERDC program will be established and recovered in accordance with division 195 of chapter 461 of the Oregon Administrative Rules by the Oregon Department of Human Services.
3. (3) Any individual or any child care provider that may be subject to the overpayment rules must cooperate fully with the Oregon Department of Human Services.
