Child Welfare is not responsible for providing child protective services when:

1. (1) A screener determines that information received during screening does not require a CPS assessment under OAR 413-015-0210(2);
2. (2) The CPS assessment has determined the alleged victim is safe; or
3. (3) The CPS assessment does not identify information sufficient to request juvenile court intervention or the CPS assessment has determined the alleged victim is unsafe and the juvenile court declines to intervene, and the parents or caregivers do not request or agree to cooperatively receive services.
