In any contested case covered by these rules (OAR 413-010-0500 to 413-010-0535):

1. (1) The Department has the burden of proof for the revocation of a certificate of approval, the suspension or revocation of a license, or the imposition of a civil penalty.
2. (2) In cases not covered by section (1) of this rule, the party has the burden of proof.
